Terms of Use – World Public Transport Day Materials
World Public Transport Day is an initiative launching on 17 April 2026 and marked every year on the same day. Brought to you by UITP and our partners across the world, it is a global celebration of the critical role public transport plays in our everyday lives, the success of our towns and cities, our economic prosperity and sustainable development.
1. Scope and acceptance
These terms and conditions (“Terms”) govern all access to and use of the World Public Transport Day campaign assets, including all files, templates, designs, toolkits, text, images, audio‑visual content and any related documentation (together, the “Materials”).
By creating an account, accessing the restricted area of this website and/or downloading, using or otherwise interacting with the Materials, you confirm that you have read, understood and agree to be bound by these Terms on behalf of yourself and, where applicable, the organisation you represent.
2. Eligible users and account security
Access to the Materials is granted at UITP’s sole discretion to UITP members, partners and other stakeholders that UITP authorises from time to time (“Authorised Users”).
You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account; you must not share your access details with any unauthorised third party and must notify UITP promptly of any suspected misuse or unauthorised.
3. Licence grant (use, not ownership)
Subject to your full and ongoing compliance with these Terms, UITP grants you a limited, revocable, non‑exclusive, non‑transferable, non‑sublicensable licence to download and use the Materials solely:
- for non‑commercial communication, awareness and advocacy related to World Public Transport Day and the promotion of public transport; and
- in accordance with any usage or brand guidelines provided by UITP in relation to the campaign (the “Licence”).
You acknowledge that you acquire only a licence to use the Materials and that no ownership or other intellectual property rights in the Materials are assigned or otherwise transferred to you.
4. Prohibited uses and licence limitations
Except to the extent expressly permitted under Section 3, you must not, and must not permit any third party to:
- sell, license, sub‑license, rent, lease, lend, transfer, assign, distribute, publish, display, or otherwise commercially exploit the Materials or any derivative works made from them;
- use the Materials in any way that is unlawful, misleading, defamatory, discriminatory, hateful, violent, or otherwise likely to harm the reputation of UITP, its members, partners or the World Public Transport Day campaign;
- remove, obscure or modify any copyright notice, trade mark, logo, attribution, disclaimer or other proprietary rights notice on or in the Materials;
- alter core campaign branding, including the World Public Transport Day logo, colour palette, primary slogans or visual identity, except where UITP has expressly indicated that certain elements are intended for local customisation;
- reverse engineer, decompile, disassemble or otherwise attempt to derive the source files or underlying design systems of any digital templates beyond what is necessary for the permitted customisation.
Any use of the Materials beyond the Licence, or after withdrawal of your access by UITP, is strictly prohibited and may constitute infringement of UITP’s intellectual property rights.
5. Intellectual property rights
All intellectual property rights (including copyright, design rights, trade marks and related rights) in and to the Materials, the World Public Transport Day name and logo, and all associated branding and content, are and shall remain the sole property of UITP and/or its licensors.
Except for the limited Licence expressly granted in Section 3, no rights (whether by implication, estoppel or otherwise) are granted to you in respect of the Materials, and UITP expressly reserves all rights not expressly granted under these Terms.
6. Customisation and your content
Where UITP expressly indicates that certain templates may be adapted, you may customise those templates by adding your own logos, translations, local information or images, provided that such customisation:
- does not alter or dilute the core campaign messages or branding; and
- complies with all applicable laws, including intellectual property and data protection laws.
If you upload, submit or otherwise share any material with UITP in connection with the campaign (including photos, testimonials, case studies, statistics or local campaign examples), you:
- warrant that you have all necessary rights, licences and permissions to provide such material and to grant the licence below; and
- grant UITP a worldwide, royalty‑free, non‑exclusive, transferable licence, with the right to sub‑license, to use, reproduce, edit, adapt, publish and communicate such material in any media for purposes connected with World Public Transport Day and UITP’s non‑commercial communication activities.
7. Monitoring, audit and enforcement
UITP reserves the right, but not the obligation, to monitor use of the Materials and compliance with these Terms, including by requesting reasonable information from you about your use of the Materials.
Upon UITP’s written request, you must promptly provide information and reasonable cooperation to enable UITP to verify that your use of the Materials complies with these Terms and to address any suspected unauthorised use or infringement.
8. Term, suspension and termination
The Licence is effective from the moment you first access the Materials and shall continue until terminated in accordance with this Section.
UITP may, at any time and in its sole discretion, suspend or terminate your account, your status as an Authorised User, and/or your Licence (in whole or in part), including where UITP reasonably believes that:
- you have breached these Terms or any applicable law;
- your use of the Materials may damage or risk damaging UITP’s reputation or the reputation of the campaign; or
Upon expiry or termination of your Licence for any reason, you must immediately:
- cease all use of the Materials; and
- delete or destroy all copies of the Materials and any derivative works in your possession or control, except to the extent you are legally required to retain specific records.
9. Disclaimers
The Materials are provided “as is” and “as available” for general information and campaign communication purposes only, without any warranties, representations or guarantees of any kind, whether express or implied, including any implied warranties of accuracy, fitness for a particular purpose, non‑infringement, or availability, to the maximum extent permitted by applicable law.
UITP does not warrant that the Materials will be error‑free or that any digital assets will always be accessible, compatible with your systems or free from viruses or other harmful components, and you are responsible for implementing appropriate safeguards and backup procedures.
10. Limitation of liability
Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law (including liability for fraud or fraudulent misrepresentation).
Subject to the foregoing, and to the maximum extent permitted by applicable law:
- UITP shall not be liable to you for any indirect, incidental, consequential or punitive loss or damage, or for any loss of profit, revenue, business, goodwill, or data, arising out of or in connection with your access to or use of (or inability to use) the Materials or this website, whether in contract, tort (including negligence) or otherwise; and
- UITP’s total aggregate liability to you for all claims arising out of or in connection with the Materials and these Terms shall be limited to the amount of fees, if any, paid by you to UITP specifically for access to the Materials during the twelve (12) months preceding the event giving rise to the claim. If no fees are charged for access, UITP’s liability is excluded to the fullest extent permitted by law.
11. Indemnity
You agree to indemnify, defend and hold harmless UITP, its officers, employees, members and partners from and against any and all claims, demands, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with:
- your breach of these Terms;
- your unauthorised or improper use of the Materials; or
- any allegation that content you upload, provide or create using the Materials infringes any rights of a third party or violates applicable law.
12. Changes to the Materials and to these Terms
UITP may update, supplement, withdraw or replace any of the Materials at any time without prior notice, including by removing outdated assets or adding new content.
UITP may amend these Terms from time to time by posting the updated version in the log‑in area; continued access to or use of the Materials after such posting constitutes your acceptance of the amended Terms, so you should review them periodically.
13. Governing law and jurisdiction
These Terms, and any non‑contractual obligations arising out of or in connection with them, shall be governed by and construed in accordance with the laws of Belgium.
The courts of Brussels shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms, without prejudice to any mandatory rights you may have under applicable law.
